{"id":1076,"date":"2022-02-23T16:04:43","date_gmt":"2022-02-23T16:04:43","guid":{"rendered":"https:\/\/staging-cochranfirmmultisite.kinsta.cloud\/memphis\/premises-liability-laws\/"},"modified":"2023-12-18T13:16:04","modified_gmt":"2023-12-18T13:16:04","slug":"premises-liability-laws","status":"publish","type":"post","link":"https:\/\/staging-cochranfirmmultisite.kinsta.cloud\/memphis\/premises-liability-laws\/","title":{"rendered":"Premises Liability Laws"},"content":{"rendered":"<h2>Property Owners Have a \u201cDuty of Care\u201d to Keep You From Being Hurt<\/h2>\n<p>If you\u2019re shopping in a supermarket, and slip and fall, you may be entitled to <a href=\"https:\/\/cochranfirmmidsouth.com\/how-are-pain-and-suffering-damages-calculated\/\">compensation<\/a> for medical expenses under \u201c<a href=\"https:\/\/cochranfirmmidsouth.com\/practice-areas\/premises-liability\/\">premises liability<\/a>\u201d laws. But you have to prove that you were hurt because of some hazard that existed, and that the property owner was <a href=\"https:\/\/statelaws.findlaw.com\/tennessee-law\/tennessee-negligence-laws.html\">negligent<\/a> for allowing it to happen.<\/p>\n<p>Property owners have what\u2019s known as a \u201cduty of care\u201d...that is, they have to reasonably maintain the property to ensure the safety of visitors.<\/p>\n<p>But in Tennessee and some other states, the property owner\u2019s \u201cduty\u201d may be limited depending on why you were in\/on the property in the first place. For example, if you were an \u201cinvitee\u201d (someone who has an open invitation by the owner to do business on the property, like a shopper in a supermarket), then there\u2019s a reasonable expectation that steps have been taken to ensure your safety. But if you did not have permission to be on the property, you\u2019re considered a \u201ctrespasser\u201d, then there\u2019s no implied promise that you will be safe.<\/p>\n<p>There are important exceptions in the case of trespassing. If the property is defined as \u201cexcessively dangerous\u201d, or the property owner intended to cause harm, he or she can be held liable. And children are not considered trespassers, which is why swimming pool owners are responsible for erecting fences and gates around the pool.<\/p>\n<h2>Landowners Protection Act in Mississippi<\/h2>\n<p>It should also be noted that the state of Mississippi passed the \"<a href=\"https:\/\/mississippitoday.org\/2019\/03\/25\/bill-to-make-it-harder-to-sue-property-owners-nearly-stalled-over-fears-of-unintended-consequences\/\">Landowners Protection Act<\/a>\" in 2019. This law states that anyone who owns, leases, operates, or maintains a commercial property in Mississippi will not be liable for any injury on the property unless the person in charge of the property did something that \"impelled\" the harmful action.<\/p>\n<p>So premises liability laws are complicated and vary from state to state.
